IntroductionMany human resources department issues are crucial to effectively manage an organization's workforce. In this regard, hiring and firing are key. These two actions can be the result of issues ranging from underperformance, violations of terms and conditions of employment, or even layoffs due to various business issues. However, they should always be performed in a professional and dignified manner so as to maintain the good reputation of the organization. Concept 1 Hiring and firing are some of the most sensitive areas in human resource management worldwide. Because of their potential influence on both the performance of other employees and a company's public image, they should be handled with the utmost care. According to the 'Lectric Law Library (2011), there are high chances of conflicts between an employer and an employee in case of termination of a contract by an employer. Therefore, when an employee is to be dismissed, this should be done in a professional manner, involving human resources personnel on the part of the authority carrying out the dismissal. The employee should be given the reason for the dismissal and appropriate documentation of the dismissal should be produced. Concept 2 It should always be clear to employees what terms and conditions have been assumed (“Lectric Law Library, 2011). Disagreements are likely to occur when a dispute emerges due to what appear to be unacceptable actions on both sides. E.g. , the issue of “work for hire” and the inclusion of the “non-compete” clause before the expiration of a certain stipulated period of time are likely triggers for disputes between employer and employee if they are not well documented in the contract.
