One of the checks and balances includes the ability of congress to overturn an executive order. By a two-thirds vote of both houses, the Senate and the House of Representatives, an executive order can be overturned. Another system of checks and balances would be the Constitution where the Supreme Court will review the executive order and evaluate its constitutionality. If the order is deemed unconstitutional, the legislative and judicial branches of government have the power to review or deny an executive order. However, their ability to do so may be based on the degree to which the party affiliation of Congress or the courts aligns with the president. The checks and balances in power through the legislative and judicial branches are only effective if these branches are not stacked with supporters of the president. The only option available to the people is to pressure their representatives in Congress to support the defeat of an order designed to ensure that they vote for a different presidential candidate in the next election.
