Between the 1830s and the early 1970s, many Aboriginal children were forcibly taken from their families, as European settlements recognized Aboriginal people as flora and fauna and they considered them to be wild. The aim of the European settlers was supposedly to force the Aboriginal people to be civilized by assimilating them into European society and culture. However, this was not the case as it was an excuse to wipe out the Aboriginal race and culture, as ordered by the Australian government at the time. Government policies and practices regarding child removal, abuse and ongoing effects have uprooted many generations of Aboriginal people. Government authorities claimed legal guardianship of all Indigenous children and removed approximately one thousand Aboriginal children from families and placed them with white Australian families or in institutions. Where Aboriginal children were often subjected to all forms of abuse on a daily basis whilst being used as servants and simply placed in homes against their will. This essay will review relevant case law, analyzing and evaluating the judgments of a particular case in relation to whether the Stolen Generation is a form of cultural genocide. This essay will also critically analyze the arguments and evidence surrounding the topic to determine whether the Stolen Generations was a form of genocide perpetrated by the Australian government at the time. II Kruger v Commonwealth The matter of Alec Kruger and other plaintiffs v the Commonwealth of Australia was heard in the High Court of Australia by Brennan CJ, Dawson, Toohey, Gaudron, McHugh and Gummow JJ. This case was brought to the attention of the High Court of Australia by one of the many plaintiffs named Rosie McCl...... at the center of the document ...... The government had the intention of overcoming race of mixed-race Aboriginals and used the excuse of assimilation, when in reality the Australian government aimed to assimilate mixed-race children into white society and its theory was that the race would eventually become extinct. From the research found it was clear that the Australian government was hiding behind the excuse of assimilation and to improve the lives of Aboriginal people this was certainly not true. But it was in any case a clear indication of cultural genocide, the Australian government was merely describing acts of cruelty against Aboriginal people by separating children from their parents and cultural communities and demonstrating only malicious acts of genocide against an innocent cultural race. Finally, it cannot be emphasized enough that the Stolen Generations should be considered cultural genocide.
