Many people argue that immigrants should not have the same rights as an American citizen, but that idea is not so American, is it? America is known as the land of the free, but if people who come here to build a life, legally, are denied their rights, we are selling false hope. When the Constitution was written, the founding fathers had everyone in mind, but now people are starting to change that idea. If memory serves, the 5th Amendment explicitly states that no person shall be held responsible for a crime unless a jury be present, nor should he be compelled in any criminal proceeding to testify against himself. Note that it doesn't say person, it doesn't say everyone excluding foreigners. One might argue that the Constitution does not apply to noncitizens, but that is not necessarily true. The Bill of Rights, which is part of the Constitution, protects the rights of every human being on American soil. Now, if the subject of the question were extraterritorial beings, this would be another matter. In an article by Macleod, she writes a very important fact, “..a non-citizen is informed of his rights after interrogation” (13) . What doesn't make sense is the fact that non-citizens are questioned and interrogated like any other suspect would but without rights. It's ridiculous. People might argue that terrorists who are sometimes non-citizens definitely don't deserve these Miranda rights, but what happened to the concept of "innocent until proven guilty"? In some cases, so-called “terrorists” are victims, simply innocent people who have been framed. Emily Bazelon raised a controversial point: “Republicans in Congress have denounced the Obama administration's softening” (9).
